This is an Agreement between SeeMore Impact Labs (referred to below as "SeeMore"), which is the owner and operator of smilabs.org, and you, the User. If you represent an organization (for example, education or training program or an employer), you will sometimes be referred to as an Organization User. Note that SeeMore may occasionally change the terms of this Agreement and all changes will be posted on the smilabs.org website.
SeeMore is committed to doing good and helping people. It has created and operates a service of significant benefit both directly to the User and indirectly to the communities in which the User lives and operates.
SeeMore and the User have a joint interest in improving SeeMore services, and will communicate with and help each other to this end.
The User and SeeMore commit to mutual respect in their interactions, including appreciating the constraints of the other and being patient and understanding when issues or conflicts arise.
SeeMore’s software is large and complex, with over a million lines of software code and thousands of pages of lessons – like all software, it will have bugs and errors. SeeMore will work diligently to address problems, but the User accepts the risk of using SeeMore services "as is". When the User encounters a problem, they should report it to SeeMore. There are Suggestion buttons on many webpages where the User can report errors, or the User can email us at support@smilabs.org or call at (303) 862-7233. SeeMore will consider in good faith suggestions submitted by Users.
SeeMore makes judgments about Users that are used by SeeMore to personalize software interactions with Users, and which also may be reported to Organization Users to which the User is affiliated in the form of grades, reports, and the like. These are best-effort judgments using computer algorithms based only on information available to SeeMore, and we encourage all those who view and use these judgments to recognize that the judgments may be incomplete or inaccurate. If a User questions the accuracy or completeness of a judgment, they should contact SeeMore immediately. In addition, Users should feel free to contact SeeMore for help in interpreting a judgment.
Any User who subverts the integrity of any SeeMore courses or certificates (such as the CSM Certificate) harms both SeeMore and all other Users. The User is responsible for all work on any SeeMore courses that is done in the User's name.
Fraudulent Use of SeeMore courses is forbidden, including:
If we judge that a User has engaged in Fraudulent Use, we reserve the right to delay issuance of SeeMore certificates (including the CSM Certificate), refuse to award SeeMore certificates, or revoke already-issued SeeMore certificates at any time. If you dispute such a judgment, please contact SeeMore and we will work with you to resolve the issue as quickly as we can.
In addition, if you have strong evidence that a User who has a verified SeeMore certificate was not the person who did the work to earn it or other indicators of Fraudulent Use, please contact SeeMore immediately.
The goal of SeeMore is to empower individuals, not to place barriers before them. At the same time, organizations are encouraged to use SeeMore certificates, including the CSM Certificate, in some cases to help identify candidates for job applications, college placement, etc. These two orientations have an underlying tension, and to resolve this, an Organization User that uses SeeMore certificates for these purposes should:
If a User is uncertain on these issues, we suggest they consult with an attorney. The ultimate responsibility for the manner of use of SeeMore services, including compliance with local, state, federal, and international laws, lies with the User, and SeeMore does not indemnify the User for their actions.
Children under the age of 18 should not use SeeMore courses and services without the supervision of a parent, guardian, or responsible adult (collectively "Responsible Adult").
If the User is under 18 years of age, they should read this agreement with a Responsible Adult and ask questions about things they do not understand. Furthermore, Users under 18 years old who are purchasing SeeMore products (e.g., a CSM Certificate) should consult beforehand with a Responsible Adult.
SeeMore engages in good-faith efforts to protect the information of all Users, which can include both biographical information (name, address, etc.), as well as information pertaining to their use of SeeMore services (progress through courses, manner of learning, typing patterns, IP address and device type information, etc.). This information is solely collected and used for purpose of uniquely identifying Users on SeeMore services and to understand the use of and improve SeeMore services.
If a User has questions about the privacy of their information, they should contact SeeMore.
Maintaining the integrity of the CSM Certificate is of critical value to both SeeMore and all Users (students and organizations). To this end, SeeMore has built a verification system that prevents cheating and ensures that a person who gets a CSM Certificate (or any future certificates offered for courses offered by SeeMore) did the work to earn it.
With this in mind, SeeMore requires all Organization Users to abide by the following rules:
If a User has any questions about these rules, they should contact SeeMore.
The User may not resell SeeMore services at a profit without prior written approval from SeeMore. For example, without prior approval, a User (e.g., a college) may charge for a User-supplied coach in a class - SeeMore is not supplying this coach as a service. However, without prior approval, the User cannot charge for use of any SeeMore service more than the User paid for SeeMore services.
SeeMore is protected by licensed copyright, and use of SeeMore services does not confer any ownership rights to the User. The User should not copy (including the frequent use of screenshots or text capture), modify, enhance or reverse engineer any SeeMore materials without prior written approval of SeeMore.
The following behaviors render a User subject to Termination from SeeMore services:
For these and other misuses of SeeMore services, or with uses of SeeMore services incompatible with the General Statement of Intent by SeeMore and User expressed earlier in this Agreement, a User may be removed from SeeMore services at the discretion of SeeMore and disallowed from ever obtaining a CSM Certificate or other SeeMore certificate. If a User has provided an email address to SeeMore, the User will be informed by email of their removal and SeeMore will retain the User information for at least 60 days, during which the User can appeal the removal by contacting SeeMore.
Termination may include preventing a User from accessing any or all parts of SeeMore’s services, including for individual Users, ceasing verification of the User's certificate by other Users, and for Organization Users, ceasing verification of User certificates that were associated with the Organization User.
If you ("Coaching Client") have engaged SeeMore Expert Coaches to assist one or more Coached Students (which may be yourself or a student in your Organization) to complete a course from SeeMore, the following terms apply:
Actions on SeeMore’s part may have untoward consequences for the User, including cases where private information may have been released, verification of a certificate may be faulty, reports of User activity may be inaccurate, and the like. SeeMore will attempt to correct any of these consequences with sincere, good faith, non-monetary efforts, such as contacting schools, employers, and the like in an expeditious manner. User agrees not to seek recovery of costs or damages in excess of any fees paid by User to SeeMore.
At the core of SeeMore’s beliefs is the desire to treat every User with respect. This not only includes the manner in which SeeMore communicates with Users, but also the seriousness with which SeeMore treats User issues, the promptness in which User issues are addressed, and more. If the User feels that SeeMore has failed in this regard, please contact the SeeMore CEO, David Goldberg, directly at david@smilabs.org.
If there is a dispute between User and SeeMore, the final means of resolution will be arbitration in the State of Colorado under normal terms of the American Arbitration Association. Arbitration serves both to reduce court costs and the time to resolve a problem, to the benefit of both SeeMore and User. The arbitrator shall award to the prevailing party that party's costs of arbitration.
